Copyright Transfer or License - How you can share your copyright and still keep it

You can transfer the copyright to an image, either by selling it or giving it away. If so, you give up all rights that you had in the image as if you never took the photograph. But the only way to give up a copyright to an image is in writing.

Even when copies of a photo are distributed, the photographer retains the copyrights to the image. If you give your client copies of the digital files, without more, you are not giving up your copyrights.

You also can give specific, limited rights for the use of that copyright, while maintaining ownership of the copyright for the image. It’s called “licensing.” For example, you give a magazine the limited right to print one of your photos. You send a copy of the digital file or the negative/chrome, but you state that you are granting the magazine specific limited usage of the image, whether it is for printing 100,000 one-run copies, for a specific time-frame, or however you want to specify the license. In a portrait or event business, you can give copies of the images to your clients so that they can have prints made. Limit their rights to personal use, only, and you keep them from selling the images to the Enquirer.

It’s the closest thing to having your cake and eating it, too. Unless you state specifically in writing and sign the document that gives your copyright to an image to someone else, you keep the copyright, regardless of what else you do.

Patent - Business Method Patents - Part II

In this second article on business method patents we’re going to continue our discussion on what happens when two companies are battling it out for the same patent.

There are two ways that an Internet patent can be used. The first way is to use it offensively against a major competitor to help eat into their market share. The second way is to use it defensively against a major competitor who is threatening to sue based on one of their patents. Case studies show that most companies are less likely to go to court when the opposing company can show that it has a patent. Usually these companies agree to a truce by cross licensing each other’s patents.

Here is an example of this.

Company A and Company B both sell tickets online. This includes services for exchanging unwanted tickets and also earning rewards for being a frequent purchaser. Company A happens to hold a patent on a method of exchanging tickets. Company B has a patent on a way of exchanging rewards points. Even though each company believes that the other company is infringing on their patent neither one goes to court over it. Instead they decide to cross license their patents so that each company can perform both services, exchanging tickets and rewards points.

So how is it determined who gets a patent? What happens when business A applies for a patent but business B can show that it was using the method for a year prior to filing? Business B can either stop the patent from going through right then and there or it can wait and invalidate the patent at a later time. The key to this whole procedure is that the use of business B’s method MUST have been public knowledge prior to business A filing for a patent. If business B used the patent confidentially then business A will be granted the patent even though business B used the method first. However, in a 1999 amendment to this law, even though business A gets the patent, business B can still use the method without any penalty.

An example of this is as follows. Business A has been using a certain method of accounting for many years but never disclosed it to the general public. Company B, over the course of time and totally unaware that business A has already created this method, develops the method themselves and files for a patent. When company B finds out that company A has been using this accounting method they file a lawsuit against company A. Company B is granted their patent but company A is allowed to continue its use of the method without any penalty of law.

Just as a note. If company A had been using the method publicly before company B filed for the patent, the patent issued to company B would have been invalidated or possibly would have never been granted at all.

The damage caused by free radicals has been linked to heart disease, cancer, arthritis, and many other conditions and illnesses. Free radical damage is also believed to contribute to many other degenerative aspects of aging, such as wrinkles, hardening of arteries, and some of the loss of mental acuity that sometimes occurs with age.

Antioxidants are available in many different forms and substances. Vitamins such as vitamin C, vitamin E, and beta carotene (a form of vitamin A) are antioxidants in addition to their other benefits to your health and well-being. Selenium and zinc are two minerals which are also antioxidants.

Other compounds; cysteine, glutamic acid, and glutathione, for example, are also antioxidants, as are natural and herbal products such as ginkgo, hawthorn, rosemary, green tea extract, and grape seed extract.

Vitamin A, in the form of beta carotene, is water soluble and can be found in vegetables such as spinach. Vitamin A is important for skin health, helps growth in children and protects against night blindness in addition to other benefits.

Cysteine is found in poultry, oats, wheat germ, egg yolks, garlic and onions, and broccoli. It can protect against toxicity from smoking or pollution.

Glutamic Acid may reduce cravings for sugar and alcohol. It aids gastrointestinal healing and helps neurological and mental disorders. It is found in animal and vegetable proteins. Pregnant women and children should probably not take supplements of glutamic acid.

Glutathione protects against damage from chemicals, smoke and other toxins. It is valuable against cancer, skin problems, and cataracts.

Grape Seed Extract is often sold as a supplement for its antioxidant qualities. While the extract is often made from seeds taken from grapes made into juice, for example, you can actually get the same benefits by enduring the taste and crunching the seeds in grapes you can buy in the produce department of your local grocery.

Green Tea and Green Tea Extract can both provide antioxidant benefits, but green tea extract may be easier to deal with, say, when traveling or on a visit, than trying to brew a cup or pot of green tea. The Truth About Psoriasis

Psoriasis is a skin disease that occurs when cells in the outer layer of skin reproduce faster than normal and pile up on the skin’s surface. This produces scaling, itchiness and irritation of the skin. Psoriasis is non-contagious.

Currently in the United States almost 5 million people are affected by this disease. It occurs in all age groups and about equally in men and women.

When psoriasis develops, thick patches of skin become red with silvery scales. Often the skin at the joints cracks making outbreak very painful. Psoriasis most often occurs on the knees, lower back, soles of the feet, scalp, elbows, face and palm.

There have been huge strides in understanding what causes psoriasis. Recently, a team from the University of Michigan looked for the gene — called PSORS1 — in more than 2,700 people from 678 families in which at least one family member had psoriasis. According to the researchers, PSORS1 is the first genetic determinant of psoriasis to be definitively identified in a large clinical trial. The finding may help in the development of new, more effective treatments for the disfiguring inflammatory skin disease.

Some other research has found that psoriasis may be a disorder of the immune system. In a normal immune system a type of white blood cell, called a T cell is produced, that normally helps protect the body against infection and disease. Top Scientists have concluded that an abnormal immune system produces too many T cells in the skin. These excess T cells trigger the inflammation and excessive skin cell reproduction seen in people who suffer with psoriasis.

Doctors usually diagnose psoriasis after a careful examination of the skin. However, diagnosis may be difficult because psoriasis often looks like other skin diseases. A pathologist may assist with diagnosis by examining a small skin sample under a microscope.

For those people who have a suppressed immune system, the symptoms of psoriasis can be extremely severe.

Dietary change can help with psoriasis, avoid alcohol, gluten which is found in wheat, barley and rye, avoid foods that are high in saturated fats, avoid red meats, dairy products, eggs, cheese and sugar and if you are a smoker, then it is best to quit.

in and beta-cryptoxanthin had the lowest risk of developing lung cancer.

The risk reduction associated with these nutrients was 69% for lutein zeaxanthin. Men with the highest blood levels of vitamin E (alpha-tocopherol) were 41% less likely to develop prostate cancer.
